Terms of Use

The agreement
Channel 3 Arcade is run by Wayfarers Digital LLC. These terms are the agreement between you and us; “we”, “us” and “our” mean Wayfarers Digital LLC, and “the service” means channel3arcade.com and the games on it. The Privacy Policy forms part of this agreement. Using the service means you accept these terms. If you do not, do not use it.
Your account
You can play without an account. To create one you must be 13 or older, and old enough to enter this agreement where you live, or have a parent or guardian’s permission. Keep your sign-in to yourself: you are responsible for everything done under your account. Keep your email address current, because it is how we reach you and how you get back in.
Unlimited and codes
Some levels, cases and modes are part of Unlimited. A code we give you unlocks Unlimited for as long as we keep that code active. Codes are personal to the people we give them to: do not sell, publish or share them. We may limit, expire or revoke a code, and anything it unlocked, at any time.
Leaderboard names and fair play
Your leaderboard name is public. Do not choose one that impersonates someone, is offensive, or suggests you speak for us. We may change or remove a name that breaks these rules.
Play fair. Do not cheat, automate play, alter the games or the requests they send, exploit bugs, or submit a score you did not earn. We may remove scores, reset progress or close accounts that break these rules. If you find a bug, tell us at support@wayfarersdigital.com.
The games are ours
The games, including their code, art, music, voices, writing, puzzles, cases, levels, solutions and answers, and the Channel 3 Arcade name and logo, belong to us or our licensors and are protected by copyright and other laws. We give you a personal, non-transferable permission to play them on channel3arcade.com, and nothing more. You may not:
- copy, download, decompile, reverse engineer, extract or reproduce any game, its code, its assets or its content, or host it anywhere else;
- extract, collect or publish answers, solutions, cases or level data, or build tools that do;
- scrape the service, get round a lock, a code or a limit, or access any part of the service other than through the games as we provide them;
- interfere with the service, its security, or other players’ use of it.
Using it decently
Do not use the service to harass, threaten or impersonate anyone, or to break the law. We can suspend or close accounts that break these terms. Where it is a plain case of abuse we will act at once; otherwise we will tell you what the problem is first.
Ending this agreement
You can stop using the service and delete your account whenever you like, on your account page. We can suspend or end your access if these terms are broken or the law requires it, and we can change or stop offering any game or the service. The sections on what is ours, what we promise, the limits on what we owe you, what you owe us, and the governing law survive this agreement ending.
What we promise, and what we do not
We build the games carefully and run the service in good faith. Beyond that, the service is provided as it is and as available, and we make no warranties of any kind, whether stated or implied. To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the service will be uninterrupted, secure or free of faults, or that progress or scores will never be lost.
Limits on what we owe you
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, profits or goodwill. Our total liability for everything arising out of this agreement or the service is capped at the greater of the amount you paid us in the twelve months before the claim and one hundred United States dollars. Any claim must be brought within one year of the thing it is about, unless the law where you live does not allow that. Where the law does not allow these limits, they apply as far as it allows, and nothing here limits liability that cannot lawfully be limited.
If you cause us a loss
You will defend, indemnify and hold harmless Wayfarers Digital LLC and its members, officers, employees and contractors from any claim, loss, liability, cost or expense, including reasonable legal fees, arising out of your use of the service, your breach of these terms, or your violation of any law or anyone else’s rights.
Things true of any agreement
This is the whole agreement between you and us about the service, together with the Privacy Policy. If a court finds part of it unenforceable, that part is narrowed to the least extent needed, and the rest stays in force. If we do not enforce something straight away, we have not given it up. You may not transfer this agreement; we may transfer it to a company that buys or merges with our business. We are not liable for things outside our reasonable control.
Changes
We may change these terms. The date at the top says when they last changed. If a change matters to you, we will tell you by email before it takes effect. Using the service after a change takes effect means you accept it.
Law, and how to reach us
This agreement, and any dispute arising out of it or the service, is governed by the law of the State of Ohio, United States, without regard to its conflict-of-laws rules. The state and federal courts sitting in Ohio have exclusive jurisdiction, and you and we each agree to them.
